Matt's law practice primarily involves commercial litigation, with a focus on construction law, including architect/engineer liability, construction defects, delay claims, mechanic's liens, and bond claims. He also assists clients in construction contract drafting and negotiation, and serves as the principal legal advisor to several construction, architecture and engineering firms.
Each year since 2003, he has been included in Woodward & White's publication of the "Best Lawyers in America" in commerial litigation. Chambers USA has included him in its list of the best construction lawyers in Texas. Each year since 2003, he has been included in Texas Monthly magazine's list of "Super Lawyers" in construction law. Since 2006, Bestofus.com has included him as one of the best commercial litigation lawyers in the United States. He is an adjunct professor at the University of Texas School of Law where he teaches courses on construction law and construction litigation.
Prior to entering law school, Matt was employed as a project manager for Fluor Daniel, Inc., one of the world's largest engineering/construction corporations. He has worked on various types of construction projects, including high-rise office buildings, high-tech facilities, warehouses, and manufacturing plants located in Texas, Maryland, and Virginia.
Matt has handled matters in numerous counties in Texas and in several other states. A sample of matters includes:
- Numerous property damage claims involving allegations of defective design and/or construction including: representation of developer in a claim by condominium HOA in connection with 16 buildings; represented engineer in claim due to water infiltration and mold at three public schools; represented engineer in claim by owner for defective design and construction; represented architect in claim due to water infiltration and mold at public high school; represented engineers in claims by owners of public and university sports arenas; representation of architect in water infiltration claim involving several buildings at a private university
- Represented an owner in a claim against a product manufacturer in a four-week jury trial involving approximately 200 properties across the United States
- Numerous delay claims on various projects including Travis County Justice Center; grain mills; water treatment plants; public schools; and semiconductor manufacturing facility
- Death of worker at jobsite; drowning death of child; deaths of six individuals at an intersection; death of infant at a medical facility; death of individual at a medical facility; numerous other serious personal injury claims involving substantial damages
- Represented contractor in a one week jury trial on a payment claim against an owner
- Represented mechanical contractor in an arbitration on a payment claim involving a subcontractor
- Represented land planner in an arbitration of a payment claim against an owner
- Represented contractor in a bench trial involving an employee's claim for sales commissions
- Payment claims and other business disputes
- Americans with Disability Act claims involving accessibility of buildings
- Substantial claims arising out of floods and surface water drainage
- Representation of professionals before the Texas Board of Architectural Examiners and Texas Board of Professional Engineers
